仓储合同的注意事项
1、主体方面
(一)保管人的资格
并不是任何个人或单位都能够从事仓储业务的，仓储合同的保管人必须是经工商行政管理机关核准登记的专营或兼营仓储业务的法人组织或其他经济组织、个体工商户等。所以在签订仓储合同之前，一定要查明保管人是否具有从事仓储的资格，并且是否在其营业执照上写明。
(二)保管人一方是代理人来签合同的情况
当保管人一方是代理人来签合同时，存货人应注意审查其是否具有代理人资格。主要注意以下两点：
1、该代理人是否具有授权委托书。在授权委托书中，应当载明代理人的姓名或名称、代理事项、授权权限、期间，并由委托人或法定代

表人或主要负责人签名、盖章。
2、代理人是否在授权范围内代订仓储合同，凡是超越代理权限而订立合同的，将因无权代理而导致合同无效。 2、仓储物
(一)仓储物是否违法
标的物违法将导致仓储合同无效，因此，在订立仓储合同时，保管人应确切地知晓存货人所存放的是什么物品，防止存货人利用仓储公司存放违法物品。
(二)合同中应注明仓储物的品名、品种、规格、数量、质量、包装方面
1、由于仓储合同的标的物是委托储存保管的货物，对于存货人来说，无论其为特定物还是种类物，均具有特定的用途，保管人不但应妥善保管，以免发生损毁，而且在保管期满后应当按约定将原物及其孳息交还存货人或其委托的第三人。因此，必须在合同中对货物的品种或品名作出明确、详细的规定。

计量单位计算;货物的质量应使用国家或者有关部门规定的质量标准标明，如货物有保质期的，也应一并说明;货物的包装由存货人负责，有国家或者专业包装标准的，执行规定标准，没有有关标准的，在保证运输和储存安全的前提下，由合同当事人约定。
(三)仓储物的验收内容、出入库手续、时间及运输
1、验收由保管人负责。通常验收的内容、标准包括三个方面：一是无需开箱拆捆即直观可见的质量情况，项目主要有货物的品名、规格、数量、外包装状况等;二是包装内的货物品名、规格、数量，以外包装或者货物上的标记为准，无标记的，以供货方提供的验收资料为准;三是散装货物按国家有关规定或合同的约定验收。验收方法有全验和按比例抽验两种，具体采用哪种方法，应在合同中明确约定。
2、合同中要注意明确仓储物的出入库手续的办理方法，双方当事人必须办理签收手续，在没有存货方在场的情况下，仓储物的出库应当与存货人原指定的第三者办理，不能直接与仓储物的买方办理。保管人在收到仓储物时，仓储物验收的时间与仓储物实际入库的时间应尽量缩短，对易发生变质的仓储物，更应注意验收时间。须注明超过验收时间所造成的实际损失，由保管人负责。仓储物验收期限，自仓储物和验收资料全部送达保管人之日起，至验收报告送出之日止，日期均以运输或邮政部门的戳记或直接送达的签收日期为准。

3、合同中还要约定仓储物在出库后是由存货人来运输还是由保管人代为发运。若是由保管人代为发运的，要明确仓储物的运输方式，是公路、铁路还是水路运输，抑或是所有运输方式都可以，并且还可以约定出库后几日内送达目的地。
(四)仓储物的损耗标准
合同中要明确约定仓储物在储存期间和运输过程中的损耗，磅差标准的执行原则。有国家或专业标准的，按国家或专业标准规定执行;没有国家或专业标准的，可以商定在保证运输和存储安全的前提下由双方作出规定。
3、保管条件
仓储物的储存条件和储存要求必须在合同中明确作出规定，需要在冷冻库里储存或是在高温、高压下储存，都应通过合同订明。特别是对易燃、易爆易渗漏、易腐烂、有毒等危险物品的储存要明确操作要求储存条件和方法。原则上有国家规定操作程序的，按国家规定执行;没有国家规定的，按合同约定储存。
