摘 要
近几年来，随着我国网络技术不断的发展，网络直播行业也随之不断发展壮大，但是其逐渐暴露的问题也越来越受到社会各界的广泛关注。随着全民版权意识的提升，又因为法律具有滞后性的特点，网络直播行业发展过于迅速，目前在我国的著作权法内并没有对网络直播进行进一步的规范，网络直播中的著作权问题也逐渐暴露出来，其中我国网络直播的著作权的归属也存在问题。通过查找大量的相关资料，以及对各类直播平台进行相应的研究调查，通过在裁判文书网找到的两个实际案例，通过对判决结果的分析比较，总结出我国网络直播著作权归属不明确的问题，并且通过对网络直播中著作权归属的考量因素进行相关的分析阐述，来为后文阐述我国网络直播中著作权归属的认定奠定理论基础和实际的基础。针对目前我国网络直播中著作权归属所存在的问题，本文还提出了几个针对性的改善建议，希望能够为解决网络直播中著作权归属问题提供一些解决思路，从而使网络直播著作权归属更为明确。

Abstract
In recent years, the network broadcast industry has developed and grown stronger constantly with the continuous development of network technology in China. However, all walks of life have paid more and more attention to its problems that are exposed gradually. With the improvement of the national awareness of copyright, everyone knows that there is no further regulation of network broadcast in China’s copyright law currently due to the hysteresis characteristics of the law and the rapid development of the network broadcast industry. As a result, the copyright problem in network broadcast is gradually exposed, in which there is also a problem in the copyright ownership of network broadcast in China. In this paper, it firstly summarized the problems of unclear copyright ownership of network broadcast in China by finding a large number of relevant materials, conducting corresponding research and investigation on various live-broadcasting platforms, finding two actual cases found on the referee document network, and analyzing and comparing the judgment results. Secondly, it conducted relevant analysis and elaboration for the consideration factors of the copyright ownership of network broadcast, thus laying a theoretical and practical foundation for the later elaboration of the determination of the copyright ownership of network broadcast in China. Thirdly, it proposed several targeted improvement suggestions in view of the current problems of the copyright ownership of network broadcast in China, hoping to provide some solutions to these problems and make the copyright ownership of network broadcast more clear.
