第六条 招标人应当按照《工程设计资质标准》的规定，提出与工程规模相适应的设计资质等级要求，不得随意提高资质等级标准排斥潜在投标人。招标人应当根据工程规模提出拟担任设计项目负责人的国家注册建筑师执业证书等级。
第七条 建筑工程设计的招标，应当按照省建设行政主管部门发布的示范文本编制招标文件，其招标公告发布、招标文件出售、答疑和澄清、截标、开标和评标、确定中标人、中标结果公示等招投标活动必须符合有关规定。

第十一条 招标人应给予中标人合理的设计周期，以保证工程的设计质量。中小型工程的初步设计时间不少于20天，施工图设计时间不少于30天；大型公共建筑工程的初步设计时间不少于30天，施工图设计时间不少于50天。
第十二条 招标人应按照国家规定的设计收费标准、允许的上下浮动幅度、设计项目的工程估算金额和计费系数在招标文件中明确设计费金额（上下浮动幅度）；投标人如对招标人公布的设计费取费金额（上下浮动幅度）有异议的，可以在招标文件约定的时间内提出质询，招标人应按规定做出澄清。投标人在投标时应做出设计费报价，其报价最高金额不得超过招标人公布的设计费金额，其上下浮动的幅度也不得超过国家规定所允许的上下浮动的幅度。招标人和中标人应按中标的设计费报价金额签订合同，不得就设计收费等实质性内容进行谈判。工程估算金额与经批准的概算金额不一致的，则以后者金额为计费基数，按实调整设计费，但招标文件约定的设计费浮动幅度不变。
第十三条 招标文件中严禁有不符合相关规范要求的含钢量和混凝土用量等指标。
第十四条 招标文件发出的同时，应当向招标主管监督部门报备。 第十五条 投标人应当按照招标文件的要求编制投标文件。
投标文件应包含资格和商务文件、技术文件，并按照招标文件规定的格式和内容要求进行编制、装订、包封和提交。
技术文件正本应当按照招标文件规定要求由具有相应资格的注册建筑师签字和盖章。
在递交投标文件时，投标人拟派出的设计项目负责人必须持注册建筑师执业证书和身份证到场验证登记。如设计项目负责人因故不能出席的，可以由该投标单位技术负责人代替（须持单位资质证书和个人身份证到场验证登记）。
第十六条 招标人应从福建省房屋建筑工程和市政基础设施工程设计评标专家库、资深专家库或地市分库中随机抽取参与建筑工程设计评标的技术、经济专家；列入国家、省重点项目的大型公共建筑工程，以及技术特别复杂、专业性要求特别高的建筑工程，采取随机抽取确定的专家难以胜任的，经主管部门同意，招标人可以从设计类资深专家库中直接确定，必要时可以邀请外地或境外资深专家参加评标。

(四)采用综合评估法的，其技术文件的评审应采用两阶段评审的办法。第一阶段进行初选，评标委员会从设计方案水平、工程投资控制、设计质量保证措施、设计进度安排和特殊施工方案或技术等方面对技术文件进行综合评议和比较，投票推荐出得票率最高的前5个投标人进入初选名单。若有效投标人不超过5个的，则全部进入初选名单。第二阶段仅对进入初选名单的技术文件进行详细评审。未进入初选名单的投标人不得推荐为中标候选人。
综合评估法采用百分制进行量化。其中商务分占10%，技术分占90%。综合评估法的评分标准见附件《福建省建筑工程设计招标综合评估法评分标准》。
技术分评分可以结合项目实际，在评分项目分值总数不变的原则框架内，由招标人确定各评审内容的分值的详细分布。
评标委员会成员应当按照招标文件所规定的评标办法和标准进行独立、客观、公正地进行量化打分。在不缺项情况下每分项得分不得低于该项分值的60%。
每一项计分时，去掉一个最高和一个最低评分，取平均值作为投标人该项得分。 评标委员会按照综合评估法的评标得分的从高到低的顺序进行排名，推荐合格的中标候选人。
第十八条 招标人应按招标文件的约定向未中标人支付方案设计补偿费。招标人因非正常情况终止实施，招标人应当向中标人支付设计费。

中标的设计项目负责人因其注册执业资格单位变动等特殊原因不能出任的，中标人应向招标人提出更换设计项目负责人申请，其替换人选的资格、经验和能力不得低于投标所报的人员，同时，中标人应当赔偿招标人损失，其更换一次扣罚设计合同总额3%，直接从设计费中扣除。
