新工伤保险条例发布暂行标准(2017最新)

按照新颁布的《工伤保险条例》，元旦起工伤职工住院就医所发生的住院伙食补助费”、统筹地区以外就医的交通食宿费”以及终止或解除劳动关系时的一次性医疗补助金”等三类费用将统一改由工伤保险基金支付。昨天，北京市人力资源和社会保障局发布了本市将实施的新《工伤保险条例》的相关待遇暂行标准，工伤职工因工伤住院发生的伙食补助费，每人每天30元。同时，一次性工亡补助金和一次性伤残补助金标准仍暂按现行规定执行，将来再由工伤保险基金对差额部分予以补支。

新增支付：
三类费用首次纳入工伤保险
北京市人保局相关负责人介绍，为方便工伤职工享受待遇，在北京市具体标准出台前，下月起本市将暂按下列支付标准执行。
住院伙食补助：对参加工伤保险的用人单位，工伤职工住院伙食补助费”标准暂定为每人每天30元。社会保险经办机构将根据工伤职工住院天数，核定住院伙食补助费金额，并支付给工伤职工。
异地就医报销：经医疗机构出具证明，报社会保险经办机构同意，工伤职工到统筹地区以外就医所需的交通、食宿费用，下月起将纳入工伤报销。其中，住宿费开支标准上限暂定为150元/人/天，在开支标准上限以内的凭据报销；伙食费实行定额包干，每人每天50元；交通费用报销中，赴统筹地区外就医的工伤职工，因行动不便，由工伤职工根据自身情况选择适合的交通工具，凭据报销。
一次性医疗补助金：按照新《工伤保险条例》的相关规定，五至十级工伤职工与用人单位解除或者终止劳动关系，由工伤保险基金支付一次性工伤医疗补助金，由用人单位支付一次性伤残就业补助金。

从明年起，参加工伤保险的用人单位，与工伤职工终止或解除劳动关系时，一次性医疗补助金标准暂按解除或者终止劳动关系时3至18个月的本市上年度职工月平均工资计算。其中五级18个月，六级15个月，七级12个月，八级9个月，九级6个月，十级3个月。社会保险经办机构根据此标准支付给工伤职工。
这三个标准待市政府作出明确规定后，再进行相应调整，多退少补。
明年补差：
一次性工亡补助金暂按现行规定执行
按照新《条例》的规定，职工因工死亡的，一次性工亡补助金标准按照上一年度全国城镇居民人均可支配收入的20倍发放。
北京市人保局相关负责人表示，因2010年度全国城镇居民人均可支配收入尚未公布，从2011年1月1日起，对于参加工伤保险的用人单位，职工因工死亡的，本市一次性工亡补助金暂时按现行规定核定，即48个月本市上一年职工月平均工资。待国家统计局公布标准后，由工伤保险基金对差额部分予以补支。

相关负责人介绍，2011年1月1日起，参加工伤保险的用人单位的职工发生工伤的，一次性伤残补助金仍由工伤保险基金暂按北京现行标准执行，待本市社会保险经办机构系统升级完成后，由工伤保险基金对差额部分予以补支。

午报讯(记者闵丹)明年起，本市将大幅上调工伤保险待遇，工伤保险的伤残津贴将人均涨303元，达到人均每月2504元。昨天，北京市人力资源和社会保障局发布2011年工伤待遇大幅上调细则，其中，护理费将在明年7月公布调整方案。
据市人力社保局介绍，2011年工伤保险待遇的调整原则，是高于养老保险金的调整水平，高于去年工伤保险定期待遇调整水平。因此，这是本市连续10年调整工伤保险定期待遇以来，幅度最大的一次。
调整范围：2010年12月31日之前已享受伤残津贴、供养亲属

抚恤金待遇的人员，从2011年1月1日起调整伤残津贴、供养亲属抚恤金待遇；2010年12月31日之前已享受护理费待遇的人员，从2011年7月1日起调整护理费待遇。
调整一：伤残津贴
伤残津贴以工伤职工本人工资的一定比例为标准。截止到10月底，伤残津贴平均值为2201元，调整后，伤残津贴实际人均增长303元，增幅为13.77%。调整幅度不仅高于2011年基本养老金的调整水平，而且高于2010年伤残津贴调整水平。
一级伤残职工伤残津贴每人每月增加350元；二级伤残职工伤残津贴每人每月增加330元；三级伤残职工伤残津贴每人每月增加310元；四级伤残职工伤残津贴每人每月增加290元。
调整二：供养亲属抚恤金
按照《工伤保险条例》的规定，供养亲属抚恤金按照职工本人工资的一定比例发给。截至2010年10月底，供养亲属抚恤金人均为1262元。2011年，拟每人每月增加150元，调整后人均1412元，增幅11.89%。

调整三：护理费
按照《工伤保险条例》的规定，生活护理费的标准为统筹地区上年度职工平均工资的一定比例。
因职工平均工资每年3月底左右才能公布，需待2010年全市职工平均工资公布后再进行调整。因此护理费自2011年7月1日起调整。
