上海市房屋租赁合同

Lease Contract

根据《中华人民共和国合同法》、《上海市房屋租赁条例》(以下简称:《条例》)

的规定,甲、乙双方在平等自愿公平和诚实信用的基础上,经协商一致,就乙方承租甲方可依法出租的房屋事宜,订立本合同。

According to 《The Contract Law Of People’s Republic Of China》《The Law Issues Of The Property Rent In Shanghai》(hereafter called: 《Law Issues》), Party A shall lease to Party B and Party B shall lease from Party A, the relevant property legally owned by Party A, and Party B agree to sign this lease agreement (the \Agreement\basis of mutual agreement, equality , honesty and mutual benefits in accordance with the relevant national and municipal laws and regulations. 一、 出租或预租房屋情况

Article 1 . Location, Area and Renovation

1-1. 甲方出租给乙方的房屋坐落在本市_ _区 室 全部(以下简称该房屋)。该房屋建筑面积为 平方米,土地用途为 居住 。甲方向乙方出示: 1-1.Party A agrees to lease to Party B its legally owned Property which is located at . (hereafter the \Property\ square meters. The stated use there is Living . 1-2. 甲方作为该房屋的 所有人 与乙方建立租赁关系。

租赁期限/续租

Article 3.

3-1. 甲乙双方约定,甲方于 年 月 日前向乙方交付该房屋。出租房屋租赁期为固定,自 年 月 日起至 年 月 日止。

If Party B desires to renew this property, Party B shall give a written notice to Party A one month prior to the expiration of the leasing period and enter into a new lease agreement upon Party A's consent. 四、

租金、支付方式和期限

Article 4. Rental, method and term of payment

4-1. 甲、乙双方约定,租金总计为人民币 元/每月。包物业。不包发票。 4-1. The total amount of rental shall be RMB .property management fee included。 Do not pack the invoice.

Payment term: Pay months rent and months deposit 第一次乙方应于 前通过转账或现金向甲方支付租金及押金共计RMB 元。 For the first timeParty B should pay all rental and deposit total by bank transfer or in cash to Party A before RMB . 4-3.租金每 个月结算一次,提前7天支付下季度租金。如乙方延迟支付租金的,乙方应支付每天0.5%的月租金作为惩罚延迟。 4-3. Rent settlement once every months. 7 days in advance payment under the quarterly rent. In the event that Party B delays the payment for the Rental, Party B shall pay 0.5% of the monthly Rental per day as a penalty for delay.

4-4. 本合同签订后. 任一方反悔不实际履行本合同的,甲乙两方均不得要求居间方退还佣金。 4-4. After the contract is signed. If either party breaks this agreement, the agency will not return the commission. 五、

保证金和其他费用

Article 5. Deposit and other Expenses

5-1.乙方应向甲方支付房屋租赁保证金,保证金为人民币 元甲方应向乙方开具收据。 5-1. Party B will pay RMB as deposit. Party A shall provide a receipt to Party B. 5-2. 租赁到期后,乙方有义务恢复房屋原状、付清相关费用并交还已清空的房屋,在此前提下,甲方应于1个工作日内将保证金全额无息退还给乙方。

5-2. At the end of the contract Party B should return apartment to Party A in the same condition as apartment was upon the time of initial rental. Party B should also pay any

outstanding bills and relative fees accrued during the rental period. After this, Party A shall return the deposit, in full without interest, of Party B within three working days to Party B.

5-3. 租赁期间,该房屋所发生的 自然损坏由甲方承担,水、电、煤气,宽带 等费用,均由乙方承担。

5-3. During the leasing period, natural damages should be paid by Party A. Water, electricity, Wifi Gas should be paid by Party B. 六、

房屋使用和维修责任

Article 6. Responsibility of repairing and using the Property

6-1. 租赁期间,乙方发现该房屋及其附属设施有损坏或故障时,应及时通知甲方修复;甲方应在接到乙方通知后的一日内进行维修,紧急情况下,应在收到乙方通知后立即进行维修。甲方在接到乙方通知后一日内未进行维修的,乙方有权自行维修,费用由甲方承担并从租金中扣除。

6-1. During the leasing period, Party B shall inform Party A when Party B finds that something is wrong with the Property or attached facilities. After Party A receives the notice from Party B, Party A shall start reparation work within one day upon reception of the notice or immediately after the information was communicated by Party B in case of emergency. If Party A does not start the reparation works within one day as from the receipt of the notice without any proper reason, Party B may proceed to the reparation at Party A’s cost and set off reparation expenses against the amount of the Rental.

6-2. 租赁期间,乙方应合理使用并爱护该房屋及其附属设施。因乙方使用不当或不合理使用,致使该房屋及其副属设施损坏或发生故障的,乙方应负责维修并承担相关费用。 6-2. During the leasing period, Party B shall take care of and use the Property and the attached facilities properly. In the event that the Property and facilities are damaged by Party B due to its improper use, Party B shall immediately repair and pay for the costs of such repairs. 七、

双方的其他义务:

Article 7. Other obligations of the Parties

7-1. 甲方应确保其对出租房屋享有的出租权利。如在租赁期内,甲方有权在最后15天给其他客人看房,但须预先得到乙方的同意。

7-1. Party A shall ensure its right of showing this apartment to other at the last 15 days. But should give Party B an hour notice and with Party B’s permission. 八、

房屋返还甲方时的状态

Article 8. Return of the Property to Party A

8-1. 除乙方续租外,乙方应在本合同的租期届满后的当日内应返还该房屋,未经甲方同意逾期返还房屋的,每逾期一日,乙方应按日租金的双倍向甲方支付该房屋占用使用费。 8-1. Except if Party B extends the lease of the Property, Party B shall return the Property on the expiration of the Term. If Party B delays in returning the Property to Party A, Party B shall pay default penalty two times daily rental.

8-2. 乙方返还该房屋应当符合正常使用后的状态并由甲方验收认可。

8-2. When Party B return the property to Party A, the property and attached facilities should be in normal used condition. Party A shall check the property and attached facilities. 九.

转租

Sub-lease

Article 9.

9-1. 除甲方已在本合同补充条款中同意乙方转租外,乙方在租赁期内,须事先征得甲方的书面同意,方可将该房屋部分或全部转租给他人。

9-1. Unless Party A agreed this in the Supplementary Agreement attached hereto, Party B can not rent the Property to any other party during the lease period unless Party B obtains Party A's written consent in advance to sub-lease the Property partly or the whole Property to other party. 9-2.

如未经甲方书面同意转租的,甲方有权提前终止合同并没收押金。

9-2. If Party B sub-leases the Property to any other party without Party A's written consent, Party A has the right to terminate the agreement and keep deposit. 十.

终止合同

Article 10. Termination

10-1. 有下列情形之一的,甲方有权书面通知乙方立即终止本合同并追究乙方赔偿责任。 10-1. Within the following cases, Party A has the right to notify Patty B by written consent to terminate this Agreement immediately and charge for relevant compensation from Party B. (一)乙方未征得甲方书面同意改变房屋用途,致使房屋损坏的;

(1) Without Party A's written consent, Party B has changed the use of the Property as stipulated in this Agreement which has damaged the Property. (二)因乙方原因造成房屋主体结构损坏的;

(2) Due to Party B’s negligence or wrongful intent, the Property’s principal construction is damaged;

(三)乙方擅自转租该房屋、转让该房屋承租权或与他人交换各自承租的房屋的;

(3) Party B without Party A’s written has sub-leased, assigned or exchanged the Property to other parties;

10-2. 有下列情形之一的,乙方有权书面通知甲方立即终止本合同并追究甲方赔偿责任。 10-2. Within the following cases, Party B has the right to notify Party A by written consent to terminate this Agreement immediately and charge for relevant compensation from Party A. (一)甲方未按时交付该房屋;

(1) In the event that Party A fails to deliver the Property to Party B in accordance with the stipulated time under this Agreement;

(二)甲方交付的该房屋不符合本合同的约定,致使不能实现租赁目的的;或甲方交付的房屋存在缺陷,危及乙方安全的。

(2) The Property to be delivered by Party A to Party B is not delivered according to the specifications of this Agreement, which cause the Property not rentable, or Party A delivers the Property defective to Party B, making Party B in dangers.

10-3. 在租赁期内,如果乙方遇特殊情况,需要终止合同,提前一个月通知甲方,并且自行找到

新的租客,继续进行合同,在甲方认可的情况下,则甲方可以退还乙方押金. 10-3. During the lease term, if Party B has to terminate the contract for special circumstances, with a one month notice in advance to Party A and find new tenant to continue the contract with the approvement of Party A, Party A should return the deposit. 十一、 违约责任

Article 11. Responsibility for Breach

11-1. 甲、乙任何一方如未按本合同条款履行,导致中途中止本合同,并且过错方又未征得对方谅解时,则视为违约,双方同意违约金为押金总额。

11-1. Failure of either Party B to observe the terms of this Agreement resulting in early termination of this Agreement and failure to obtain understanding of non defaulting Party by the defaulting party shall deem to amount to a breach of the Agreement, the Deposit shall be forfeited. 11-2. 租赁期间,甲方不及时履行本合同约定的维修、养护责任,造成乙方损失的,甲方应承担赔偿责任。

11-2. If during the leasing period, the Party A delays the renovation and maintenance works on the Property as agreed by Party A in this agreement, Party A shall be responsible to compensate any damages suffered by Party B. 十二、 其他条款 Article 12. Other issues

12-1. 本合同自甲、乙双方签字生效。 居间方仅为见证人,除4-4的约定外,与本合同的实体权利义务无关。

12-1. This Agreement shall come into effect upon signature by both Parties. The agency is an intermediate as witness, in addition to 4-4 in the agreement, it has nothing to do with the entity rights and obligations.

12-2. 本合同未尽事宜,经甲、乙双方协商一致,可订立补充条款。本合同补充条款及附件均为本合同不可分割的一部分,本合同及其补充条款和附件内空格部分填写的文字与铅印文字具有同等效力。

12-2. The matters not covered in this Agreement may be included in a supplementary agreement after negotiation and consent by both Parties. The terms of supplementary agreement and other lists on appendix shall be the integral part of this Agreement. The handwritten characters have the same effect as the printed characters in this contract.

12-3. 甲、乙双方在签署本合同时,对各自的权利、义务、责任清楚明白,并愿按合同规定严格执行。如一方违反本合同,另一方有权按本合同规定索赔。

12-3. Before signing this Agreement, both Party A and Party B have the full capacity for such civil action and are clear about their rights, obligations and responsibilities and willing to strictly act as this agreement. In the event that one Party breaches this Agreement, the other Party has the right to compensation in accordance with this agreement. 12-4. 本协议受中华人民共和国法律管辖。
