执行回转与执行错误赔偿之区别
司法实践中，有的人民法院用执行回转的办法解决执行错误所造成的后果，即以执行回转代替执行错误赔偿。这种做法，不仅混淆了执行回转与执行错误赔偿的界线，而且严重侵犯了当事人的合法权益。产生这个问题的原因，要么是没有弄清二者的含义和区别;要么就是规避法律。因此，很有必要加以澄清。
执行回转与执行错误赔偿虽然均属于权利救济的范畴，都是对执行行为所造成受损权益的恢复。但是，二者不是同一概念。其产生的原因、法律的适用和责任的承担则有着明显的区别。
一、执行回转与执行错误赔偿的概念及产生的原因不同。
执行回转，是指在执行程序终结后，据以执行的法律文书被撤销，取得利益的一方将所得利益返还给被执行人，使执行标的恢复到原来的状态。适用执行回转的情形概括起来基本上有两种，即：(一)人民法院制作的判决书、裁定书、调解书执行完毕后，发现确有错误，被人民法院依法撤销;(二)法律规定由人民法院执行的其他法律文书，

如仲裁机关裁决书、公证机关赋予强制执行效力的债权法律文书等被撤销的。
执行错误赔偿，是指执行没有发生法律效力的法律文书或者人民法院没有按照发生法律效力的判决、裁定、调解、支付令、仲裁裁决、具有强制执行效力的公证债权文书以及行政处罚、处理决定等执行，导致了执行上的错误而产生的赔偿。执行错误赔偿，由于是没有按照发生法律效力的法律文书去执行，所以执行错误赔偿的情形仅限于：(一)执行尚未发生法律效力的判决、裁定、民事制裁决定等法律文书;(二)违反法律规定先予执行的;(三)违法执行案外人财产且无法执行回转的;(四)明显超过生效法律文书确认的数额、范围无法执行回转的; (五)在执行过程中，对查封、扣押的财产不履行监管职责，严重不负责任，造成财产毁损、灭失的;(六)在执行过程中，变卖财物未经合法评估机构估价，或者应当拍卖而末拍卖，强行将财物变卖他人的;(七)违反法律规定的其他情形。
这里，执行回转产生的原因，是据以执行的法律文书被撤销，即原生效法律文书错误，被依法撤销而引起执行回转。而执行错误产生的原因，则是没有按照生效法律文书去执行。
二、执行回转与执行错误赔偿适用的法律不同。

执行回转与执行错误赔偿，由于概念、情形和产生的原因不同，因而，除个别情形外，在适用法律上也有着明显的不同。执行回转适用的法律是《民事诉讼法》和相关诉讼法及最高人民法院的司法解释。而执行错误赔偿除个别情形适用上述法律外，其适用的法律主要是《国家赔偿法》及相关司法解释。
《民事诉讼法》第114条规定：“执行完毕后，据以执行的判决、裁定和其他法律文书确有错误，被人民法院撤销的，对已被执行的财产，人民法院应当作出裁定，责令取得财产的人返还;拒不返还的，强制执行。”最高人民法院《关于适用〈民事诉讼法〉若干问题的意见》第275条规定：“法律规定由人民法院执行的其他法律文书执行完毕后，该法律文书被有关机关依法撤销的，经当事人申请，适用《民事诉讼法》第214条的规定。”上述规定，就是执行回转的法律依据。而执行错误赔偿的法律规定则是我国《国家赔偿法》第2条关于“国家机关和国家机关工作人员违法行使职权侵犯公民、法人和其他组织的合法权益造成损害的，赔偿请求人有依照本法取得国家赔偿的权利。”和第31条规定：“人民法院在民事诉讼、行政诉讼过程中??.或者对判决、裁定及其他生效法律文书执行错误，造成损害的，赔偿请求人要求赔偿的程序，适用本法刑事赔偿程序的规定。”同时，还有《最高人民法院关于民事、行政诉讼中有关司法赔偿若干问题的解释》中相关规定。

三、执行回转与执行错误赔偿的责任承担不同。
执行回转与执行错误赔偿，二者有着质的区别，这就决定了在责任的承担、义务履行上也就不同。
执行回转，是将已执行的财产再执行回去，由取得财产的人返还给被执行人，即将执行的标的恢复到原来的状态。但这种再执行是由于生效法律文书错误被撤销导致的。就执行本身而言，无论是原执行还是再执行，均无过错。
而执行错误，则是由于没有按照生效法律文书去执行而导致错误执行。这种错误的执行，具有过错和违法性，又多为职权行为，且往往会给当事人造成一定损害。因此，这种质的不同，决定了执行回转责任的承担和义务的履行只能是取得财产的人，执行回转不能造成的损失也只能由申请人自己承担。执行回转不是《国家赔偿法》调整的范围：国家不承担赔偿责任。执行错误造成执行回转不能最终承担责任的则是国家，履行义务的则是执行错误的机关。执行错误的机关履行义务后，可对有过错的执行人员，依法予以追偿。
明确执行回转与执行错误赔偿的区别，对于正确适用法律处理执行回转与执行错误的不同案件，避免责任转嫁，充分保护合法权益，树立人民法院公正执法形象，不无裨益。
