2017年1月，中央政法委、财政部、最高人民法院、最高人民检察院、公安部、司法部等6部委联合印发了《关于建立完善国家司法救助制度的意见(试行)》。目前，按照党的十八届三中全会决策部署，全国已基本建立起统一完备的司法救助制度。
司法救助，又称诉讼救助，是指人民法院在诉讼中，通过对当事人缓交、减交或免交诉讼费用的救济措施，减轻或者免除经济上确有困难的当事人的负担，保证其能够正常参加诉讼，依法维护其合法权益的法律制度。
一、哪些人能够得到国家司法救助?

根据《关于建立完善国家司法救助制度的意见(试行)》，对下列人员提出国家司法救助申请的，应当予以救助：
(一)刑事案件被害人受到犯罪侵害，致使重伤或严重残疾，因案件无法侦破造成生活困难的;或者因加害人死亡或没有赔偿能力，无法经过诉讼获得赔偿，造成生活困难的。
(二)刑事案件被害人受到犯罪侵害危及生命，急需救治，无力承担医疗救治费用的。
(三)刑事案件被害人受到犯罪侵害而死亡，因案件无法侦破造成依靠其收入为主要生活来源的近亲属生活困难的;或者因加害人死亡或没有赔偿能力，依靠被害人收入为主要生活来源的近亲属无法经过诉讼获得赔偿，造成生活困难的。
(四)刑事案件被害人受到犯罪侵害，致使财产遭受重大损失，因案件无法侦破造成生活困难的;或者因加害人死亡或没有赔偿能力，无法经过诉讼获得赔偿，造成生活困难的。
(五)举报人、证人、鉴定人因举报、作证、鉴定受到打击报复，致使人身受到伤害或财产受到重大损失，无法经过诉讼获得赔偿，造成生活困难的。

(六)追索赡养费、扶养费、抚育费等，因被执行人没有履行能力，造成申请执行人生活困难的。
(七)对于道路交通事故等民事侵权行为造成人身伤害，无法经过诉讼获得赔偿，造成生活困难的。
(八)党委政法委和政法各单位根据实际情况，认为需要救助的其他人员。
涉法涉诉信访人，其诉求具有一定合理性，但通过法律途径难以解决，且生活困难，愿意接受国家司法救助后息诉息访的，可参照执行。
申请国家司法救助人员，具有以下情形之一的，一般不予救助：对案件发生有重大过错的;无正当理由，拒绝配合查明犯罪事实的;故意作虚伪陈述或者伪造证据，妨害刑事诉讼的;在诉讼中主动放弃民事赔偿请求或拒绝加害责任人及其近亲属赔偿的;生活困难非案件原因所导致的;通过社会救助措施，已经得到合理补偿、救助的。对社会组织、法人、不予救助。
二、国家司法救助的资金是从何而来呢?

(一)国家司法救助资金的筹集。坚持政府主导、社会广泛参与的资金筹措方式。各地国家司法救助资金由地方各级政府财政部门列入预算，统筹安排，并建立动态调整机制。已经建立的刑事被害人救助资金、涉法涉诉信访救助资金等专项资金，统一合并为国家司法救助资金。中央财政通过政法转移支付，对地方所需国家司法救助资金予以适当补助。同时，各地要采取切实有效的政策措施，积极拓宽救助资金来源渠道，鼓励个人、企业和社会组织捐助国家司法救助资金。
(二)资金管理和监督。各级政府财政部门严格资金管理，确保管好、用好救助资金。政法各单位在年度终了1个月内，向救助领导小组报送当年发放救助资金的明细情况，接受纪检、监察和审计部门监督，确保专款专用。对个人、企业和社会组织捐助救助资金的，应当告知救助的具体对象，确保资金使用的透明度和公正性。
(三)责任追究。对截留、侵占、私分或者挪用国家司法救助资金的单位和个人，违反规定发放国家司法救助资金造成重大损失的单位和个人，骗取国家司法救助资金的相关人员，严格依纪依法追究责任，并追回救助资金。
