产品质量侵权的证据标准(2018年)是怎么样的

一、产品质量不合格的赔偿证据有哪些

1、产品原物、遗留物或照片;

4、人身、财产受到侵害及损害后果的证明;

二、产品质量不合格的赔偿责任认定

1、任何一项产品责任的承担都以产品存在缺陷为前提;

2、缺陷产品造成了消费者或第三人的人身伤害，或者造成了缺陷产品以外的财产损害：

三、产品不合规的法律定义

1、生产、销售不符合保障人体健康和人身、财产安全的国家标准、行业标准的产品。《产品质量法》第四十九条对生产、销售这类质量不合格产品的违法行为有明确的处罚规定。在执法实践中，查处这类违法行为的案件过去主要集中在食品、药品等产品。但《药品管理法》

和《食品安全法》出台后，这类案件的查处明显减少，主要原因是在执法过程中对保障人体健康和人身、财产安全的认定较难。笔者认为，通过对《标准化法》第七条：“……保障人体健康，人身、财产安全的标准和法律、行政法规规定强制执行的标准是强制性标准，其他标准是推荐性标准。”的理解，只要涉案产品的检验依据是强制性标准，那么经营经检验不合格的此类产品的行为，就应当属于生产、销售不符合保障人体健康和人身、财产安全的国家标准、行业标准的产品的行为，产品检验不合格报告就是认定此类违法行为最权威的证据。

2、以不合格产品冒充合格产品。对这类违法行为，《产品质量法》第五十条作了明确的处罚规定。在具体实践中，一些执法部门及执法人员对“以不合格产品冒充合格产品”的认定存在争议，焦点主要集中在是否须固定“冒充”行为的主观证据。“肯定说”认为，此种行为表现为明显的故意特性，必须固定相对人在主观方面故意的证据，否则不能认定行为人实施了以不合格产品冒充合格产品行为。“否定说”则认为，固定这类证据没有必要，因为这类行为不以故意的存在为必要条件，过失情况下也应该属此类行为。全国人大法制工作委员会副主任卞耀武主编的《中华人民共和国产品质量法释义》(简称《释义》)指出，不合格产品冒充合格产品是指将不合格产品进行伪装，充当合格产品的违法行为;《国家质量技术监督局关于实施〈中华人民共和国产品质量法〉若干问题的意见》(简称《意见》)第八条第一款第八项规定，不合格产品冒充合格产品是指以不合格的产品作为或

者充当合格产品。《释义》解释的关键词是“伪装”、“充当”，带有明显的故意;《意见》解释的关键词是“作为”、“充当”，主观上同样属于明知故犯。笔者认为，《释义》和《意见》的解释对“不合格产品冒充合格产品”的界定大体上一致，并无本质区别，即生产者、销售者主观上应当有故意行为。在办案时，应当固定相应的证据。

3、生产者不知道所生产的产品是不合格的。即生产者在主观上没有故意行为。主要表现为：生产者在原料采购、生产过程控制(包括原辅料配比)、产品出厂检验等过程中无弄虚作假行为的情况下，将经自身检验为合格的产品，或将未经检验的产品打上检验合格标签后销售。而实际上，受检验人员素质、检验设备、检验试剂等各种非主观故意因素的影响和制约，导致未发现该批产品质量不合格。一些执法人员将此类违法行为也按不合格产品冒充合格产品来定性，显然有失法律的公平、公正性。但《产品质量法》对此类违法行为并未规制，这种立法漏洞只能靠以后对《产品质量法》进行修订时弥补。笔者认为，在当前情况下，应按照《产品质量法》第十七条的规定，通过公告、责令停业、限期整顿等措施，对此类违法行为的生产者开展产品质量后处理工作。
