一、法律依据
1、《人民法院对外委托司法鉴定管理规定》 2、《人民法院司法鉴定工作暂行规定》

二、鉴定的提起
法院基于当事人的请求，委托司法鉴定机构进行司法鉴定。
三、鉴定机构的选择
由双方当事人共同选择或法院指定。

1、相同点：第一，都是一种证据；第二，鉴定的基本程序相似；第三，法院审查与评断的标准基本相似；第四，在实际判案中的效力基

2、差异性。
第 一，两者之间构成逻辑上的包容关系。按照《医疗事故处理条例》第二条的规定：“医疗事故，是指医疗机构及其医护人员在医疗活动中，违反医疗卫生管理法律、 行政法规、部门规章和诊疗护理规范、常规，过失造成患者人身损害的事故。”同时规定造成患者死亡或残疾的，分别构成一至三级医疗事故，如果造成患者明显人 身损害的其他后果的则构成四级医疗事故。该规定较老的《医疗事故处理办法》扩大了医疗事故的处理范围，将一般性医疗过错（此处指狭义的过错）构成的事故也 归入其中。但实践中，有些过错很难达到事故的定性标准，但却给患者造成了损害，怎么办？实践中就出现了医疗过错司法鉴定。而且已有司法鉴定机构自去年开 始,就受理对医疗事故技术鉴定结论不服的复核鉴定申请，进行医疗过错（此处指广义的过错）司法鉴定，这一实践扩大了医疗过错鉴定的范围，使两者间构成包容 关系。
第二、两者的鉴定主体不一。现行医疗事故鉴定主体是各级医学会，而鉴定专家多是各级医院的任职医师，由于不可避免的原因，在实践中 就难免会发生不公正的现象。而司法鉴定主体特别是上海市司法鉴定中心，直接受上海市司法局领导，经上海市司法鉴定工作委员会授权，承担各类司法鉴定委员会 的鉴定组织工作，是一个面向社会

的鉴定机构。其下的上海市人身伤害司法鉴定专家委员会直接开展对医疗过错的司法复核鉴定。其鉴定人员都是具有高级职称的专 家，虽然与医学会的专家有一定的重合，但由于要求特别严谨，所以鉴定结论有明显差异，实践中也出现多起医疗事故鉴定被司法复核鉴定推翻的案例。
第 三，两者的庭审质证程序明显不同。按照《条例》，只有卫生行政部门才能对医疗事故鉴定结论进行审查，那么，在司法审判实践中，法院应如何审查？这似乎是一 个很难的问题。其实在《人民法院对外委托司法鉴定管理规定》及《人民法院司法鉴定工作暂行规定》中，对鉴定结论的审查都规定了详细的程序及标准，特别规定 鉴定人有依法出庭宣读鉴定结论并回答与鉴定相关提问的义务。然而，我们不难发现，在现行医疗事故鉴定报告上均无鉴定人员的签名，也就让法院无法通知鉴定人 到庭接受质证，这一重要的司法审查程序根本无法进行，于是许多鉴定结论在没有充分审查的情况在就被采信了。而在司法鉴定中，每一份鉴定报告书上均有鉴定人 员的签名，如果当事人对鉴定结论不服均可申请鉴定人员出庭接受质证，在这样严谨的司法审查程序下，法院作出的判决是公正的。
