摘要：近几年来我国经济飞速发展，各行各业与国际市场接轨的趋势愈加明显。
虽然目前我国尚未完全对外开放建筑市场，但是在经济全球化的大环境下，我国建筑市场的对外开放无疑是必然的。而且现在我国已有许多施工队伍走出国门，前往中东及非洲参与各种援建项目。在复杂的涉外援建项目中，索赔是时常发生甚至不可避免的。然而由于我国在工程索赔方面尚不十分完善，这使得我国的施工队伍在国际工程中难以占据主动地位。本文主要站在参与涉外工程的我国施工队伍的角度上，通过认识索赔的实质，探讨索赔的方法，分析成功的索赔案例等，以说明索赔的重要性，并尝试提出改善现状的几点措施，主要包括增强索赔意识，培养专业人才等。

Abstract： The Chinese economy rises in an astonishing speed above these years,
which makes the trend of integrating into international market on all trades much more clear. China haven’t open the construction market to the globe now, but it’s under the trend too. So the opening of Chinese construction market is certain. And right now many Chinese contractors appear in international aid construction projects in the Middle East and Africa. The international aid construction project is very complicated, during the project, construction claims happen frequently, sometimes even necessary. However, since the construction claim is not very ripe in China , it is rough for Chinese contractors to seize the initiative. This paper stands on the Chinese contractors’ points of view, shows the importance of construction claim and try to give several means include awakening of construction claims; educating professional brains by understanding the essence of construction claim; exploring the methods of construction claim; analyzing the successful cases of construction claim, etc.
