侵犯财产权的行政赔偿

我国《国家赔偿法》第4条规定，行政机关及其工作人员在行使行政职权时有下列侵犯财产权情形之一的，受害人有取得赔偿的权利：

2、违法对财产采取查封、扣押、冻结等行政强制措施的；
3、违反国家规定征收财物、摊派费用的；
4、造成财产损害的其他违法行为。

造成财产损害的其他违法行为”是指《国家赔偿法》第4条前3款规定的行为以外的行政违法行为，例如：
1、行政机关对公务员作出的奖惩任免决定违法，从而损害了该公务员的财产权益；
2、行政机关及其工作人员侵犯企业、农村承包经营户的经营自主权造成财产权益损害；
3、行政机关违法发放许可证，造成申请人之外的公民、法人或者其他组织财产权益损害的；
4、行政不作为造成公民、法人或者其他组织财产权益损害的。
关于侵犯财产权的赔偿，我国《国家赔偿法》第28条要求按照下列规定处理：
1、处罚款、罚金、追缴、没收财产或者违反国家规定征收财物、摊派费用的，返还财产；
2、查封、扣押、冻结财产的，解除对财产的查封、扣押、冻结，造成财产损坏或者灭失的，依照本条第(3)、(4)项的规定赔偿；

3、应当返还的财产损坏的，能够恢复原状，不能恢复原状的，按照损害程度给付相应的赔偿金；
4、应当返还的财产灭失的，给付相应的赔偿金；
5、财产已经拍卖的，给付拍卖所得的价款；
6、吊销许可证和执照、责令停产停业的，赔偿停产停业期间必要的经常性费用开支；
7、对财产权造成其他损害的，按照直接损失给予赔偿。
通过这一法律规定不难看出，现行法律规定的侵害财产权的损害赔偿的范围及其有限。返还财产”、解除对财产的查封、扣押、冻结”和恢复原状”属于与赔偿并行的责任形式，这些责任形式的功能各不相同，不能彼此互相代替。因此，可以说国家赔偿法规定的对侵犯财产权的损害赔偿的范围甚至没有达到赔偿直接损失的最低要求，更谈不上惩罚性赔偿的问题。应当加重侵犯财产权的行政赔偿责任。

1、行政机关工作人员与行使职权无关的个人行为造成的损害；
2、因公民、法人和其他组织自己的行为发生的损害；
3、国防、外交等国家行为造成的损害；
4、行政机关制定、修改法规、规章或其他规范性文件造成的公民、法人或者其他组织利益丧失；
5、根据我国民法通则、刑法等法律上的原则和规定，因不可抗力、意外事件造成的损害，国家不承担赔偿责任。
行政机关及其工作人员为了公共利益、他人利益和自身的合法权益行使正当防卫权的行为，以及紧急避险行为造成的损害，国家也不承担赔偿责任。
