立案监督是《刑事诉讼法》赋予检察机关的一项重要刑事监督职能，对促进规范执法、公正执法具有重要的作用。我国《刑事诉讼法》虽把刑事立案活动纳入了监督范畴，但其主要针对公安机关应当立案而未立案情况，对于公安机关不应当立案而立案情况的监督，尚无具体而明确的法律规定，而不应当立案而立也是一项关乎公民、法人合法权利的十分严肃的刑事诉讼活动，也应纳入立案监督的范畴，特别是在我国的文化背景和道德观念中，一个人即使只被侦查机关作为犯罪嫌疑人立案侦查，在社会上都会对之产生相当负面的影响。

(2)申请人的基本情况。写其姓名、性别、年龄、籍贯、职业或工作单位和职务、住址。
(3)案由。写明是何公安局在何年何月何日作出的不立案决定，并且注明其文号。
2.正文。包括申请目的和申请理由两部分。
(1)申请目的。目的是让人民检察院提起法律监督程序，经过审查，通知XXX公安局对何案立案侦查。
(2)申请理由。要将犯罪嫌疑人实施的犯罪事实叙述清楚，主要写明犯罪的时间、地点、动机、目的、手段、行为过程和危害后果等要素，同时要用确实、充分的证据对影响定罪的主要事实加以证明。根据相关刑法条款，写明犯罪嫌疑人的行为已经涉嫌构成了何罪，写明公安机关不予立案的理由和法律依据，说明其不予立案是不对的，从而请求人民检察院提起法律监督程序，通知公安机关立案。 3.尾部。
