上海房屋拆迁的补偿标准(2017年最新版)
浦东新区规土局、各区、县房地局、房管局、崇明县建委：
为贯彻执行《上海市危棚简屋改造地块居住房屋拆迁补偿安置试行办法》(以下简称《试行办法》)，现就有关问题提出如下实施意见：
一、关于适用范围
《试行办法》第二条关于“经市建设委员会核定的危棚简屋改造地块”是指1996年4月22日后由市房地局具体确认的危棚简屋改造地块。
二、关于指定银行
《试行办法》第十二条中指定的银行，是指中国建设银行上海市分行。
三、关于房屋拆迁许可证申请事项

凡属危棚简屋改造地块的拆迁基地，拆迁人应在拆迁计划和拆迁方案中具体明确货币化安置方案，并将不低于拆迁安置总费用的10%的资金存入拆迁基地所在区、县的建设银行支行和建设银行浦东分行，以确保拆迁货币化安置的实施。
非危棚简屋地块的拆迁基地，拆迁人参照本《试行办法》的，也应按本条上款规定执行。
上述资金经银行验资证明后方可抵冲相应现房数量。
四、关于私房补偿标准
《试行办法》第三条规定的补偿标准，是指市政府(93)38号令第39条规定。私房所有人选择不保留私房产权，用公房安置或货币化安置的，其私房补偿款按估价标准的60%计算。
五、关于安置人口的计算
《试行办法》中凡涉及人口计算的，仍按《上海市城市房屋拆迁管理实施细则》第四十四条、第四十五条核定。

六、关于安置地段划分
《试行办法》第六条中的安置房屋地段，按沪房地拆(1997)第489号文执行。?
七、关于面积换算
原公有居住房屋居住面积，换算成建筑面积按沪房地拆(1997)557号文的规定执行。
八、关于应安置面积
《试行办法》中的应安置面积指以《试行办法》第五、六、七条面积的总和。?
九、关于被拆迁人安置方式的选择
被拆迁人选择货币化安置方式的，应当以书面形式向拆迁人提出。?
被拆迁私有房屋共有人书面提出放弃私房产权的，但共有人之间对公有房屋安置与货币化安置达不成一致意见时，应当用房屋安置。

十、关于货币化安置款同等分配比例的问题
《试行办法》第十二条“将货币化安置款按同等分配比例”，是指扣除独生子女增加建筑面积的货币安置款后，房屋各使用人平均分配，独生子女增加面积部分的款额应加在该独生子女名下。
十一、关于货币化安置款余额的问题
《试行办法》第十五条“余额部分可以由被拆迁房屋使用人以现金方式提取”，其中余额须在安置款额的30%以下，方可以现金方式提取。同时，被拆迁人购买商品住宅不得造成居住困难(人均建筑面积不低于10平方米)。
十二、关于参照执行问题
1、《试行办法》第十八条关于本市市区范围，也包括五、六级地段。
2、被拆除房屋地段在五级地段的，原地安置时，不增加安置面积;五级地段安置到六级地段的，按照《试行办法》第五条规定的计算标准增加 20%安置面积。

拆除房屋在六类地区的，被拆迁人在同一类地区从较好区位迁入较差区的，其增加安置房屋面积的具体标准，由被拆除的房屋所在地的区、县人民政府制定。
货币化安置时，安置款的计算按五或六级地段空置商品住宅的平均售价计算，即：货币化安置款=五或六级地段商品住宅的平均售价×在五或六级地段安置应得的房屋建筑面积×80%.
关于非危棚简屋地块拆迁基地，被拆迁人要求按《试行办法》补偿安置的，拆迁人应当按照《试行办法》执行。
