2008年11月11日下午，申请人之子xxx(病人)因身体不适到被申请人处就诊，并住院治疗。至11月13日下午，经检查，诊断为肺血栓”，并将病情告知病人。至11月14日凌晨，申请人接到医院病危通知后，赶到医院时，看见病人躺倒在离病床2米远的地上，左脸有一伤口，血流至耳朵(已凝固)，且手脚冰凉，已死亡。因被申请人工作人员违反医疗护理常规，草率治疗，未及时做转院处理，抢救不力，导致病人不治身亡。
一、被申请人工作人员违反医疗常规，未给病人进行病理检查就让其住院，且至住院第二天即11月12日已经在给病人用肺血栓针(已经证实得了肺血栓，当天费用清单为证)，第三天下午，才检查出病人患的是肺血栓”，延误了病情，使病人未得到及时救治，而不治身亡。不仅如此，被申请人在明知病人病情很严重的情况下，不仅没有及时给病人予以救治，而且直至病人死亡时，采取的均为二级护理，病房中无任何救治设备放置，且病人死亡时，并非死在自己的病床上，而是死在离自己病床2米远的地上，且脸上有血。从以上情形不难看出，院方未尽到应尽的医治和护理义务，严重违反医疗常规，对病人未给予及时救治和护理，是导致病人死亡的最直接原因。
二、被申请人诊断出病人的病情为肺血栓”后，根据诊疗常规，在明知自己无医治条件的情况下，对病人未及时做出转院处理或特级

护理，也未及时通知申请人陪护，亦未及时将病人病情严重的情况告知申请人(即下发病危通知书)。使病人的感染不能得到有效的控制，病情恶化，且抢救不力，也是导致病人死亡的主要原因之一。
三、被申请人未履行告知义务。被申请人在诊断结论出来后，在明知病人病情很严重的情况下，还不及时告知病人家属可能导致的不良后果，使病人在不知情的情况下接受了草率的治疗和护理，造成病人身体损害，病情迅速恶化，最终导致死亡。
四、被申请人在病人死亡后，其工作人员对病人的死亡原因的解释前后不一致，先前说是肺血栓”，过后又不承认(此有病人的亲属及校方、同事的质询为证)。对院方的此做法，让人难以理解，使申请人有理由相信院方在对病人的死亡原因上，有推托医责的嫌疑。
综上所述，被申请人工作人员严重不负责任，违反医疗护理常规，抢救不力，未及时做出转院处理，并且未履行告知义务，造成病人病情恶化，最后不治身亡，因果关系明显。鉴于以上事实和理由，现申请作医疗事故技术鉴定。 此致
