行政伦理制度化建构之困境探析

【摘要】Institutionalization of administration ethic has been the major approach to discuss how to build administration eth- ic in academic circles. There is no doubt that institutional arrangement has established its basic status and been in accordance with Chinese situations at the stage of system defect. However, it has defects. To clarify defects can explore other choices, make proper use of it and avoid its abuse. Public administrators being ＂complex human＂ act as various roles, suffer from their tensions and fall into ethic dilemma, which can＇t be solved by institutional arrangement and is an extreme exposure of the defects.%行政伦理制度化一直是学界讨论如何建设行政伦理的主要途径。不可否认，制度安排在行政伦理建设中确实具有基础性地位，并且符合我国还处于制度缺失这一阶段的实际国情。但是，制度主义路径是有其缺陷的。只有明确其缺陷，才能更好地探究制度安排路径之外的选择，也才能恰当地利用制度主义路径以避免对这一路径的滥用。作为“复杂人”的公共行政人员，身负各种角色以及多种角色所带来的张力，从而面对一系列的伦理困境，而由角色所带来的困境恰恰是制度安排无法解决的，并且使其缺陷暴露无遗。 【总页数】4页(35-38)
