承诺捐款不兑现或成被告
捐赠者开空头支票”将被追索，随意拿着募捐箱上街头募捐属违法行为??昨日，《湖南省募捐管理条例(草案)》(以下简称《条例》草案)举行立法听证会，20名来自社会各界的听证代表在为该立法叫好的同时，围绕如何完善或进一步细化草案各抒己见。
据悉，《湖南省募捐管理条例》已纳入我省明年的立法项目，有望明年出台。市民如对《条例》草案有什么意见和建议，也可拨打热线82205000反映。
募捐主体混乱催生地方立法
早在2007年，我省便开始酝酿出台《募捐管理条例》。省民政厅慈善办主任杨柯表示，目前，我国还没有制定出台慈善公益事业方面的系统法，1999年制定的《中华人民共和国公益事业捐赠法》也只对捐赠进行了规范，没有募捐”的相关内容，制定出台地方性的募捐管理条例尤为必要。当前，社会募捐存在的最突出问题是募捐主体混乱和募捐行为失范，无论是慈善公益组织、社会团体，还是企事业

单位、政府部门都在社会上公开募捐，在募捐中，没有严格遵循自愿原则，募捐款物的管理、使用缺乏透明度，有些募捐活动仅以募捐为名，行营利之实。这些问题的存在，不利于慈善公益事业的健康发展。
《条例》草案分为总则、募捐行为、社会募捐款物的管理与使用、扶持与奖励、法律责任、附则六章。其主要内容明确了开展募捐必须坚持的基本原则，即公益原则、公开原则和自愿原则，提出了募捐备案制度和公告制度，明确了募捐管理责任的措施，规定了违反规定的法律责任制度等等，对保护捐赠人和受赠人的合法权益、规范募捐组织的募捐行为、合理配置募捐资源、促进我省募捐事业的健康发展都有积极意义。
个人随意上街募捐将被禁止
《条例》草案对募捐主体进行了限制，如明确募捐主体应该是红十字会、慈善会、依法成立的公募基金会，或法律规定可以开展募捐的其他公益性非营利单位。此规定一旦明确，也就意味着禁止个人拿着募捐箱随意上街头开展募捐，如某学校为帮助出现意外、急需救助的同学时，只能在学校内部开展募捐，不能让学生随意拿着募捐箱上街募捐。

广播、报刊、杂志、网站等媒体可以联合募捐组织共同开展募捐，并以募捐组织的账户接受募捐资金。企事业单位、其他组织和个人开展义演、义卖、义拍、义赛等活动，也应当联合募捐组织共同进行，所得款物应全部移交募捐组织。
捐赠开空头支票”将被追索
近年来，面对媒体镜头，捐赠者一诺千金”却不兑现的新闻并不鲜见，募捐者却因缺乏相应法律支持而出现无法追索的尴尬。参加听证会的一些慈善公益组织负责人在发言中说，该组织接受的大量捐赠中，有极个别捐赠者承诺捐赠甚至还开走了相应票据，可至今仍没有兑现捐赠。
《条例》草案对捐赠者诺而不捐”的行为作出明确规定，捐赠人所捐赠款物不能当场兑现的，募捐组织应与捐赠人签订载明捐赠款物种类、质量、数量和兑现时间等内容的捐赠合同。捐赠人应兑现捐赠承诺，捐赠人不履行捐赠合同或者捐赠承诺的，募捐组织应该向捐赠人追索;追索未果的，应当向社会公告，并依法提起民事诉讼或者申请仲裁。与会听证代表对该规定表示支持。
《条例》草案还规定，捐赠款物在使用时，募捐组织应按照募捐方案确定的使用范围和时间，及时使用募捐款物。捐赠人对捐赠款物

有使用用途要求的，应按照其要求使用，确需改变用途的，应征得捐赠人的同意。
募捐成本宜控在10%以内
为了广泛听取社会意见，省民政厅特别邀请了民主党派人士、教授、律师、基层工作者、社团协会负责人、群众共20人参加立法听证会。代表们各抒己见，从不同层面，不同角度提出合理化意见，对募捐主体细化、募捐救助行为应突出公益性，加强募捐备案管理，突出重大自然灾害和公共危机的劝募行为等等都提出了建设性的意见，对草案进行了必要的修改和补充。
与一般听证会相比，昨日的募捐立法”听证相对比较简单，其中在募捐成本列支条款中，大家形成一个比较一致的观点：即募捐成本列支应当厉行节约，应控制在10%以内。
《条例》草案拟明确，募捐组织在募捐中发生的必要成本支出，可以从募捐金额中列支，募捐中发生的成本支出包括募捐活动期间和募捐款物管理使用中发生的相关费用,如信息发布、宣传费用，物资的清洗消毒，仓储、搬运、运输等费用，信息反馈的信函印制、邮寄等费用，工作人员在募捐期间的工资、交通、通讯等费用，义演、义赛、义卖、义拍的场地租赁等费用。
